Duration of The Trademark Registration

Subject to the filing of appropriate maintenance documents between the initial fifth and sixth year anniversary of the registration date, federal trademark registrations remain in force for ten years, and may be renewed for perpetual ten year periods so long as the mark is continuously used in commerce.

The renewal application is filed in the tenth year of the relevant registration period and must also contain the appropriate fees and a declaration of continuing use in commerce.

NOTE: regarding Grace Period Filings: The above documents will be accepted as timely if filed within six months after the deadlines listed above with the payment of an additional fee.
